Any person or entity (“User”) visiting, using or otherwise accessing the site at www.lootaudio.com (the “Site”) or any of the information contained in the site agrees to and is bound by the following terms and conditions of this visitor agreement (“Agreement”). The collection, use and sharing of your personal data is subject to our Privacy Policy

1. Introduction

Welcome to Loot Audio Ltd (“Loot Audio”, “we”, “us”). These Terms & Conditions ("Terms") govern your access to and use of our website and any hardware or software products you purchase (“Products”). These apply to both digital and physical goods and distance sales within the UK and EU. Our Privacy Policy also applies.

3. Use of the Site

This Site is intended only for the purposes specified on the Site. Use of the Site and/or the Content is entirely at your own risk. Please note that, whilst we endeavour to provide and host accurate and useful information, the Content may be inaccurate and is subject to change, often at very short notice.

4. Registration

You may choose to register an account with the site to access additional features. To register with the Site, you must agree to the terms of this policy and our Privacy Policy and agree to keep your password secure and confidential and not allow anyone else to use your email address or password to access the Site. You are responsible for anything that happens through your account unless you close it or report misuse. Any personal information provided by you will be treated with appropriate care and security in accordance with our Privacy Policy.

5. Ownership of Content

Loot Audio, unless otherwise stated, owns or controls all relevant rights in the Site and the Content. You may not publish, distribute, extract, re-utilise, or reproduce any part of the Site or its contents in any form (including storing it in any medium) other than as expressly allowed herein. All products obtained from Loot Audio are for personal use only and must not be shared with any third party or uploaded to any file sharing site or offered for resale or public transmission unless mixed into your own original music productions. The Content is subject to change at any time and Loot Audio gives no warranty or guarantee that any particular item of Content will be available at any given time (or at all).

6. Hacking

You agree not to attempt to damage, deny service to, hack, crack, reverse-engineer, or otherwise interfere (collectively, “Interfere”) with the Site in any manner. If you in any way Interfere with the Site, you agree to pay all damages incurred by Loot Audio. Loot Audio will cooperate with the authorities in prosecuting any User who Interferes with the Site or otherwise attempts to defraud Loot Audio or any other parties through User’s use of the Site or services provided via the Site. Loot Audio reserves the right to deny any or all access or service to any User for any reason, at any time, at our sole discretion. User agrees that we may block User’s IP address or addresses at any time, and at our sole discretion to disallow User’s continued use of the Site without giving you any advance notice. We reserve the right to take any action we may deem appropriate in our sole discretion with respect to violations or enforcement of the terms of this Agreement, and we expressly reserve all rights and remedies available to us at law or in equity.

7. Complaints

If you believe that you are the owner of the copyright or other rights in any material(s) appearing on Loot Audio, and/or that ownership of the copyright or other rights in any material has been incorrectly used or represented on Loot Audio, please contact us

8. Trade Marks

Loot Audio acts as a marketplace platform for third-party product creators ("Vendors"). As part of their product listings, Vendors upload various materials, including but not limited to product descriptions, preview audio files, and promotional images (collectively, "Third-Party Content").

All Third-Party Content is the sole responsibility of the Vendor who originated it. Loot Audio does not claim ownership of, and has no control over, the content provided by third parties.

Loot Audio is not responsible or liable for any Third-Party Content, including its accuracy, integrity, quality, or legality. This includes, without limitation, any liability for copyrighted images or audio uploaded by the Vendor. The responsibility for ensuring that all uploaded materials do not infringe upon any third-party intellectual property rights lies firmly with the product creator.

If you believe any Third-Party Content infringes upon your copyright, please follow our procedures outlined in Section 7.

The brands, products and service names used in this Site (including without limitation, “Loot Audio”) are the trade marks or trade names of Loot Audio or its trading partners unless otherwise stated. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or taglines without the prior written permission of Loot Audio. Loot Audio are not affiliated with Native Instruments or any other company that sells products on our site.

9. Changes to this Agreement

This Agreement and/or any other terms of service may be changed without prior notice, and any such amendment will be applicable to all Users from the date and time such revised terms have been posted on the Site. User’s continued use of the Site or services constitutes agreement with and acceptance of any such amendment or other changes.

10. Law and Jurisdiction

This Agreement shall be governed by and will be construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the United Kingdom Courts.

11. Your Information

If you provide any information to the Site, you agree to provide only true, accurate and complete information to us and/or the Site. Any personal information provided by Users will be treated with appropriate care and security. By registering with the Site and accepting this Agreement, you are also accepting and agreeing to our Privacy Policy.

12. Communication

You can choose to subscribe to certain communications and newsletters from us. If you subscribe to our newsletter we will store your email address in order to communicate with you. You can unsubscribe at any time by clicking the unsubscribe link at the bottom of any email we send to you and updating your preferences. You can also update these preferences in your account and choose the frequency at which you will receive newsletters. If you enter your email address in one of our newsletter subscription boxes found around the site we will store your email address in our database and only use it for communicating with you in the ways that you selected. We will never share, sell or distribute your email address.

13. Purchasing Products from Loot Audio

All products purchased from or through Loot Audio (“Products”) are for your own personal use only and must not be shared with or given or transferred to any third party or uploaded to any file sharing site or offered for resale or public transmission unless mixed into your own original music productions. The contract between you and Loot Audio for the purchase of Products is formed in each case only when we accept your payment and make such Products(s) available for you to download and/or delivery. Loot Audio offers an audio player service to allow you to preview sounds and demos. You may not record, store or otherwise use any such streamed Content other than to listen to and preview the selections offered.

14. Your Use of Products

All Products are sold subject to the terms of the licence for use granted by us (“User Licence”). The User Licence grants you the right to use and integrate the purchased loops and/or samples within your original mixed music productions (and no additional fee or royalty is required for such integrated use).

15. Payment and Pricing

You may pay for any purchased items using any of our approved debit or credit cards or one of our approved e-money providers. You agree and acknowledge that currency rates change daily and that any exchange rate quoted on the Site is merely a representation of a recent currency rate and that you will be charged according to the actual rate at the applicable time.

Distance Selling Regulations

1. Contract Formation

• Product listings are not binding offers.
• A contract is only formed once we accept your order and dispatch confirmation.
• We reserve the right to decline or cancel orders (e.g., for out-of-stock items) and will refund you promptly.

2. Pre-Contract Information

Before purchase, we will clearly inform you of:

• Our identity, address, and contact details.
• Product descriptions, prices inclusive of VAT, delivery charges.
• Payment, delivery timelines, and your cancellation rights under distance?selling laws.
• Currency, technical requirements, and essential system requirements for digital goods.

3. Shipping & Delivery

• Standard delivery times will vary depending on destination and selected shipping method.
• Estimated delivery times will be provided at checkout.
• If we are unable to ship within 15 days of accepting your order, you are entitled to cancel the order and receive a full refund.
• You are responsible for providing accurate delivery details. We are not liable for non-delivery due to incorrect or incomplete address information.
• Courier & Fulfilment: Orders are shipped using DPD as our primary courier, with fulfilment managed through Sendcloud.
• Dispatch Time: We aim to ship all physical goods on the next working day after your order is placed (subject to availability).

Shipping Destinations & Costs:

• UK Mainland: Free delivery
• UK Non-Mainland (Jersey, Guernsey, Isle of Man, Northern Ireland): £30
• Europe (EU Member States): £35
• Rest of World: Shipping is not available at this time

Shipping costs are clearly shown at checkout and added to your order total. Shipping costs are subject to change at any time due to fluctations in shipping prices. You will receive tracking details via email once your item has shipped.

4. Pricing and Payment

• Prices include VAT unless stated otherwise.
• Exchange rates for foreign currency orders are based on the rate at the time of transaction.
• Payment methods include credit/debit cards, PayPal, Klarna, and other providers.

5. Right of Withdrawal (Physical Goods only)

As a consumer, you have the right to cancel physical good orders within 14 days of receipt.

• Notify us (via email).
• Return goods within 14 days.
• You are responsible for any costs associated with returning your item to us.
• Items must be returned in original condition and unused.
• We’ll refund within 14 days of notice or receipt, using the original payment method only.
• You’re only liable for reduced value due to excess usage beyond checking functionality.

6. Exclusions from Withdrawal Rights

Withdrawal rights do not apply to:

• Downloaded digital products once downloaded or if the serial number has been redeemed.
• Sealed software if the seal has been broken.

7. Extended Returns Guarantee

We offer a 14-day satisfaction guarantee on unopened hardware. You can return it for any reason—costs covered by us for UK orders.

8. Faulty Items & Warranty

All goods come with statutory warranties. If items are defective:

• Report within a reasonable time.
• We’ll refund, repair, or replace as appropriate.

9. Digital Products & Licensing

• Downloadable software is sold under a limited license.
• No withdrawal rights once download begins or software unsealed.
• Use is governed by the End-User License Agreement (EULA).
• Faults in digital products: report within 14 days. We will repair, replace, or refund defective digital goods.

10. Intellectual Property

All IP rights remain with Loot Audio or licensors. You may not copy or distribute our content except as permitted under its license.

11. Limitation of Liability

• We are not liable for indirect/consequential losses.
• Liability is limited to the purchase price for defective or misrepresented goods, to the maximum extent allowed by law.

12. Data & Cookies

• Our Cookie and Privacy Policies explain data use and cookie settings.

13. Changes to Terms

• We may modify these Terms at any time. Any changes will apply to future orders.

14. Governing Law & Disputes

• UK orders: governed by English law.
• EU orders: governed by applicable EU member state law, respecting mandatory consumer protections.
